The EEOC reports that the top five most commonly filed employee suits are:

1. Sex discrimination and harassment (30.1 percent)
2. Retaliation (22.2 percent); 3. Race discrimination (13.5 percent)
4. Disability discrimination (12.8 percent)
5. Age discrimination (8.2 percent)

Common issues in the workplace include: Age discrimination, this is on the rise due to baby boomers returning to the workforce. Whistleblower protection Employee Internet and E-mail intrusion of privacy.

Average compensation to claimants based on employee size.
15-100 employees: $50,000
101-200 employees: $100,000
201-500 employees: $200,000
501 or more: $300,000
